Employer prosecuted after ignoring PIN

The Department of Education has become the first Victorian employer to be prosecuted for not complying with a Provisional Improvement Notice (PIN).
Altona Primary School failed to comply with a notice requiring it to provide and maintain adequate staff room facilities for employees. Consultants advised previously advised the school the facilities were too small.
The Department of Education pleaded guilty to breaching the Occupational Health and Safety Act last month in the Melbourne Magistrates’ Court.
The Department was ordered to pay a fine of $8,000.
NUW OHS Lead Organiser said the case showed that employers needed to take PINs seriously.
“Improvement notices aren’t issued for fun, but because there is genuine risk to health and safety at the workplace.
“I hope this case sends a strong signal to employers that PINs need to be acted on quickly when issued by employees.”
